Destined for an LPAT hearing (under the old OMB rules) on September 24th, the developer made the following adjustments to the application: Toronto and East York Community Council approved the modified proposal at its July 4th meeting (click for Staff Report). Participants, asking what happens next, have been told that:
The applicant will advise the LPAT of the settlement offer and therefore the 2 week hearing scheduled to begin in September will be adjusted to a one-day settlement hearing. At the settlement hearing, the applicant will be required to provide planning evidence in support of the settlement and all registered parties/participants will also be given the chance to speak (in support or opposition of the settlement). It appears that lawyers for one party (Allied Properties) might well speak in opposition (click for letter): Our client remains opposed to this application and request that Toronto East York Community Council refuse the staff report or, in the alternative, to send this matter back to staff for further consideration with respect to an appropriate setback from the public lane.
