City Council authorize the City Solicitor and the Director, Community Planning, Toronto and East York District to prepare and present a settlement, to be presented to the Local Planning Appeal Tribunal jointly with the applicant, based on the following:

- a maximum height of 50 metres including mechanical penthouse
- a loading space configuration to require vehicles to exit the site in a forward motion, without the need for a reversing motion from the loading space into the public lane
- a door on the servicing/loading area to help contain sound
- the Construction Management Plan to include vibration monitoring for the integrity of surrounding buildings
- the 3rd storey outdoor amenity terrace to include a landscaped buffer so that residents cannot get up to the edge and throw cigarette butts into neighbouring back yards
